These Terms and Conditions ("Terms") govern your access to and use of our website gpsclinic.co.in, our GPS tracking devices, software, mobile applications, tracking platforms, fuel monitoring systems, and all related products and services (collectively referred to as the "Services").
By accessing our website, purchasing our products, creating an account, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use our website or Services.
About GPS Clinic:
GPS Clinic is engaged in the sale, installation, configuration, maintenance and support of GPS tracking solutions and related services, including but not limited to:
GPS tracking devices for cars, motorcycles, school buses, commercial vehicles and fleets;
Fleet Management and Vehicle Tracking Services;
Personal and Employee Tracking Solutions;
SIM-based GPS Tracking Services;
Fuel Monitoring Systems (FUEL);
Web-based and mobile GPS tracking platforms;
Installation, maintenance and technical support services.
We may offer products manufactured by various brands including, but not limited to, Concox, Teltonika, Atlanta, Roadpoint, Meway, Omnicomm, itrangle and other manufacturers. Product specifications, availability, compatibility, software features and pricing may change without prior notice.
Eligibility:
You represent and warrant that:
You are at least 18 years of age and legally competent to enter into a binding contract under applicable Indian laws.
All information provided by you is accurate, complete and up to date.
You will use our Services only for lawful purposes.
Business entities using our Services confirm that the individual accepting these Terms has authority to bind the organization.
Customer Accounts:
Certain Services require registration of an account.
You agree to:
maintain accurate account information;
protect your username and password;
immediately notify us of any unauthorized access to your account; and
accept responsibility for all activities carried out through your account.
GPS Clinic shall not be liable for losses arising from unauthorized use of your account caused by your failure to maintain account security.
Orders and Payments:
All prices are quoted in Indian Rupees (INR) unless otherwise specified.
Orders are confirmed only after payment is received or as otherwise agreed in writing.
GPS Clinic reserves the right to:
refuse or cancel any order;
correct pricing or typographical errors;
limit quantities purchased; and
cancel transactions suspected to involve fraud or misuse.
Applicable taxes, including GST, shall be charged in accordance with prevailing laws.
Shipping and Delivery:
Delivery timelines are estimates only and are subject to courier availability, logistics constraints, weather conditions and other factors beyond our reasonable control.
Ownership and risk in the products pass to the customer upon delivery at the shipping address provided by the customer.
Customers are responsible for verifying shipment details and notifying GPS Clinic promptly of any delivery discrepancies.
Installation and Device Compatibility:
Certain products require professional installation, compatible vehicles, power supply, mobile network coverage and satellite reception.
GPS Clinic shall not be responsible for improper installation performed by unauthorized persons, modifications made by third parties or incompatibility caused by alterations to the vehicle or equipment.
Warranty:
Products supplied by GPS Clinic are covered by the manufacturer's warranty or the warranty communicated at the time of sale.
Warranty does not cover damage resulting from:
improper installation;
misuse or negligence;
physical damage;
water ingress;
electrical surge;
unauthorized repairs or modifications;
accidents;
normal wear and tear.
Warranty claims may require inspection of the device before approval.
Returns, Replacement and Refunds:
Returns, replacements and refunds shall be governed by our applicable Return and Warranty Policy.
Products damaged due to customer misuse or returned without authorization may not qualify for replacement or refund.
Installation charges, subscription charges and service fees are generally non-refundable unless required under applicable law.
Subscription Services:
Certain Services require active subscriptions, SIM connectivity, data plans or periodic renewal charges.
Failure to renew subscription fees may result in suspension or termination of tracking services.
SIM recharge costs, telecom charges and data charges payable to third-party service providers are the responsibility of the customer unless expressly included in the purchased plan.
Software License:
GPS Clinic grants customers a limited, revocable, non-exclusive, non-transferable license to use its software, mobile applications and web portals solely for lawful personal or business use.
You shall not:
copy;
modify;
reverse engineer;
decompile;
distribute;
sublicense;
sell;
commercially exploit; or
create derivative works from
our software without our prior written consent.
All intellectual property rights remain the exclusive property of GPS Clinic or its licensors.
Acceptable Use:
You agree to use our Services responsibly and in compliance with all applicable laws.
You shall not:
use our products for unlawful surveillance;
stalk, harass or intimidate any individual;
track any person, vehicle or asset without obtaining all legally required permissions or authorizations;
interfere with the operation or security of our Services;
attempt unauthorized access to our systems;
use our Services for criminal or fraudulent activities; or
violate the privacy rights of any individual.
Where employee tracking is implemented, customers are solely responsible for complying with applicable employment laws, privacy obligations and obtaining all required notices or consents.
GPS Clinic reserves the right to suspend or terminate Services if unlawful or unauthorized use is suspected.
GPS Accuracy and Availability:
GPS tracking performance depends upon various external factors including:
satellite visibility;
GSM/mobile network coverage;
internet availability;
weather conditions;
surrounding structures;
signal interference;
hardware condition; and
power availability.
Accordingly, GPS Clinic does not guarantee uninterrupted service, continuous connectivity, real-time updates or absolute location accuracy.
Approximate location accuracy may vary and should not be relied upon for emergency response, life-saving purposes or safety-critical decisions.
Communications:
By contacting GPS Clinic or providing your contact details, you consent to receive communications relating to your orders, subscriptions, invoices, renewals, technical support and service updates through telephone calls, SMS, email, WhatsApp or other legally permitted communication channels.
Promotional communications will be sent only in accordance with applicable laws. You may opt out of promotional messages at any time; however, service-related communications necessary for the operation of your account may continue.
Third-Party Services:

telecom operators;
cloud hosting providers;

payment gateways;
software vendors; and

GPS Clinic is not responsible for interruptions, failures, inaccuracies or delays caused by third-party providers.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law.
Indemnity:
You agree to indemnify, defend and hold harmless GPS Clinic, its directors, employees, representatives, dealers and affiliates from any claims, losses, liabilities, damages, costs and legal expenses arising from:

unlawful tracking activities;
infringement of any third-party rights; or
breach of applicable laws.
Suspension and Termination:
GPS Clinic may suspend or terminate access to any Service without prior notice if:
subscription fees remain unpaid;
these Terms are violated;
fraudulent or illegal activity is suspected;
required by law; or
continuation of Services poses a security risk.
Termination shall not affect accrued rights or outstanding payment obligations.

These Terms shall be governed by the laws of India.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located at Chhatrapati Sambhajinagar (Aurangabad), Maharashtra, India.

Updated Terms become effective immediately upon publication on our website unless otherwise stated.
